Florida Estate Sales Inc. makes no representations or warranties, express or implied, regarding the condition, authenticity, age, rarity, or provenance of any item. No refunds or returns will be accepted for any reason once a sale is finalized. All items are sold as final sale.
Inspection: All items are available for inspection online prior to bidding. It is the bidder's responsibility to inspect the item(s) and be satisfied as to its condition and value before placing a bid.
Special Categories (Collectibles): Items such as comic books, baseball cards, and other collectibles are not graded or guaranteed. All condition assessments are subjective, and Florida Estate Sales Inc. makes no guarantees regarding any stated condition, rarity, or value of collectible items. Bidders are responsible for conducting their own due diligence.
2. Bid Release Fee for Accepted Returns
In the rare event that Florida Estate Sales Inc. permits a return, a 20% bid release fee will be charged, based on the hammer price, to compensate for administrative costs and time lost. All returns must have written authorization from Florida Estate Sales Inc. Unauthorized returns will be returned to the bidder at their expense. Items not claimed or paid for will incur a storage fee of $20 per day, and if storage fees exceed the item's value, ownership will revert to Florida Estate Sales Inc.
3. Shipping & Local Pickup
Shipping: Florida Estate Sales Inc. handles shipping either in-house or through a designated third-party provider. Florida Estate Sales Inc. collects shipping payments, including third-party shipping costs, as a convenience for bidders to streamline the process. The bidder will have a single point of contact for all shipping-related matters.
- Shipping Fees: Shipping costs, whether handled in-house or by third-party providers, are paid directly to Florida Estate Sales Inc.
- DocuSign Agreement: A DocuSign agreement will be sent to the bidder to facilitate third-party shipping charges. Refusal or failure to complete the DocuSign agreement will require the bidder to arrange and pay for their own third-party shipping provider.
- Insurance: Domestic shipments will include $100 of insurance by default. Additional insurance is available upon request at the buyer's expense. International shipments are not insured beyond this coverage, and Florida Estate Sales Inc. is not responsible for lost or damaged international shipments.
- Claims: All shipping claims for loss or damage must be made within 3 days of receipt. Failure to notify us within this time frame forfeits your claim.
Local Pickup: Buyers may pick up items by appointment at 1500 Apalachee Pkwy STE 2135, Tallahassee, FL 32301.
4. Credit Card Payments, Chargebacks & Additional Payment Methods
By using a credit card to register or pay, the bidder agrees that they will not initiate a chargeback or dispute the transaction with their credit card provider. All sales are final, and the bidder waives any right to file a chargeback for buyer's remorse or any other invalid reason.
If a chargeback is attempted after taking possession of the item, it will be considered theft under Florida law. Florida Estate Sales Inc. reserves the right to pursue legal action, including prosecution under cybershoplifting laws, and to recover any associated legal and administrative costs.
Accepted payment methods include credit card, bank wire, Cash App, Zelle, and cash. By using any of these payment methods, the bidder agrees to all terms and conditions.
5. Lots & Bidding Terms
All Sales Are Final: Once a bid is accepted, it constitutes a binding contract. No refunds or returns will be granted under any circumstances.
Condition of Lots: Descriptions and condition reports are provided to the best of our knowledge and ability, but Florida Estate Sales Inc. makes no guarantees about the accuracy or completeness of such descriptions. All items are sold as-is.
Bidder Responsibility: It is the bidder's responsibility to educate themselves about the item(s) prior to placing a bid. By placing a bid, the bidder agrees to the terms of sale and acknowledges that they have inspected the item(s) to their satisfaction.
Bid Release Fees for Errors: In the event of a verified technical error, a $100 or 10% of the hammer price fee (whichever is higher) will be charged if Florida Estate Sales Inc. releases the bidder from their obligation.
6. Buyer's Premium, Payment Terms & Non-Payment Consequences
Buyer's Premium: A 25% buyer's premium will be added to all winning bids. This premium is considered part of the purchase price and subject to state and local sales tax where applicable.
Payment Terms: Payment is due within 4 days of the auction. Failure to pay within 4 days may result in the sale being declared null and void at the discretion of Florida Estate Sales Inc. The bidder will remain responsible for any applicable fees and penalties until the sale is officially voided.
Non-Payment Consequences: Florida Estate Sales Inc. reserves the right to engage a third-party collection agency to recover unpaid balances. This agency may report non-payment to all three major credit bureaus (Equifax, Experian, and TransUnion), potentially affecting the bidder's credit rating. Additionally, Florida Estate Sales Inc. will file a strike to suspend the bidder's account, preventing future bidding activity. Legal action may also be pursued as deemed necessary.
Accepted forms of payment include credit card, bank wire, Cash App, Zelle, and cash. Non-U.S. bidders must pay via bank wire or money order.
7. Legal Binding & Jurisdiction
This agreement is governed by the laws of the State of Florida and is made and performed in Leon County, Florida. All disputes arising from this contract will be resolved in the courts of Leon County. Arbitration is required before filing any court action.
Any attempt at a fraudulent chargeback or failure to complete payment may result in legal action under cybershoplifting laws.
8. Identification & Verification
Bidders must provide accurate contact information at the time of registration, including full name, address, phone number, and email. Florida Estate Sales Inc. reserves the right to verify this information and may request photo identification. False information or failure to verify identity may result in disqualification from the auction.
9. General Terms
Consignor Bidding: Consignors are prohibited from bidding on their own items (shill bidding).
Auctioneer's Discretion: Florida Estate Sales Inc. reserves the right to withdraw any lot or nullify a sale at its discretion.
